The automatic stay is one of the most immediate and significant protections bankruptcy provides. It's a court-ordered injunction that takes effect automatically — without a judge needing to sign anything specific to your case — the moment a bankruptcy petition is filed.
What it stops
In general terms, the automatic stay halts most collection activity against the debtor. That typically includes collection calls and letters, lawsuits related to debt collection, wage garnishments, repossession efforts, and — often most urgently for filers — foreclosure proceedings and eviction actions in many circumstances. Creditors who continue collection efforts after being properly notified of the stay can potentially face consequences from the court.
Why it matters
For many people, the automatic stay is the most immediate relief bankruptcy offers — it creates breathing room the moment a case is filed, before any other part of the process has played out. That's part of why accuracy and timing in the initial filing matter so much.
It isn't absolute
The stay has exceptions and limits. Certain actions — such as some criminal proceedings, certain family law matters like child support collection, and some specific tax proceedings — generally aren't stopped by the stay. In some situations, a creditor can also ask the court for permission to proceed despite the stay (commonly called a "motion for relief from stay"), and for filers who have had recent prior bankruptcy cases, the stay's duration or scope can be more limited. Whether a specific action is covered by the stay in a specific case is a legal question.
It also doesn't last forever
The automatic stay generally remains in place while the bankruptcy case is pending, though it can end earlier in certain circumstances — for example, if the case is dismissed, if a court grants a creditor relief from the stay, or once the case concludes. What happens at the end of the case, and how it interacts with any secured debts like a car loan or mortgage, again depends on the specifics of the case.
