What Happens at a 341 Meeting?
General educational information — not legal advice.
This article provides general, publicly available information. It is not legal advice, and reading it does not create a professional relationship with Black Diamond. Black Diamond Bankruptcy Document Preparation is not a law firm.
Named for the section of the Bankruptcy Code that requires it, the "341 meeting" — formally the meeting of creditors — is a required step in every Chapter 7 case. Despite the name, it tends to be far less dramatic than it sounds.
Who's actually in the room
This is not a court hearing, and there is no judge present. It's run by the case trustee — the person appointed to administer your bankruptcy case — and typically takes place in a conference setting or, increasingly, by phone or video. Creditors are legally entitled to attend and ask questions, but in most consumer Chapter 7 cases, no creditors show up at all.
What generally happens
The debtor is placed under oath and asked a series of questions by the trustee, generally covering things like confirming your identity, verifying that the information in your petition and schedules is accurate and complete, and asking general questions about your income, assets, and any recent financial transactions. For most straightforward, no-asset cases, this portion of the meeting is brief — often just a matter of minutes.
How to prepare
Generally, filers are expected to bring government-issued photo identification and proof of their Social Security number, along with any documents specifically requested in the notice sent after filing. Beyond that, the best preparation is simply having reviewed your petition and schedules closely enough to answer questions about them accurately — which is part of why accuracy in the initial paperwork matters so much.
What it isn't
The 341 meeting is not where the court decides whether to discharge your debts, and it's not a venue for legal argument about your case. If a trustee or creditor has a specific objection to your case, that's typically handled through separate legal proceedings, not resolved on the spot at the meeting.
Where document preparation fits
Black Diamond Bankruptcy Document Preparation can help make sure your petition and schedules are accurate and complete going into your 341 meeting, which reduces the chance of the trustee flagging inconsistencies. We don't attend the meeting with you, represent you at it, or advise you on how to answer the trustee's questions — that's the kind of representation only a licensed attorney can provide.
